Terms of Service

1. Definitions

"Service" means the MyRepDay software-as-a-service product available at app.myrepday.com. "You" means the customer organisation entering into these terms. "We," "our," or "us" means Stacksy Pty Ltd (ABN 19 691 241 291), trading as Stacksy.

2. The Service

We provide a web-based application for planning, scheduling and logging field-sales activity. The Service is provided on a subscription basis as described on our Pricing page.

3. Your account

You are responsible for keeping account credentials confidential, for all activity under your account, and for ensuring that everyone you invite to use the Service abides by these terms.

4. Acceptable use

You agree not to use the Service for unlawful purposes, to upload malicious code, to attempt to access other customers' data, or to interfere with the Service's operation. We may suspend accounts that breach this clause.

5. Billing and subscription

The Service is billed monthly in advance, in Australian Dollars, plus GST where applicable. Per-rep pricing is calculated from the active reps in your organisation each billing period and prorated for additions or removals during a period.

6. Free trial

New organisations receive a 14-day free trial. No credit card is required to start. At the end of the trial, you may add a payment method to continue, or your account will pause without charge.

7. Cancellation

You can cancel any time from your billing settings. Cancellation takes effect at the end of the current billing period — there are no refunds for partial periods.

8. Data ownership

You own the customer data you upload to the Service. We hold it on your behalf for the duration of your subscription. You can export your data at any time. After cancellation we retain it for 90 days, then permanently delete it.

9. Confidentiality

We treat your data as confidential and will not access it except as required to operate the Service, respond to support requests, or comply with law.

10. Warranties and disclaimers

We provide the Service "as is" and to the maximum extent permitted by law disclaim implied warranties. Nothing in these terms limits any rights you have under Australian Consumer Law that cannot lawfully be excluded.

11. Limitation of liability

To the extent permitted by law, our aggregate liability under these terms is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages.

12. Indemnity

You agree to indemnify us for losses arising from your breach of these terms or your unlawful use of the Service.

13. Changes to the Service or terms

We may modify the Service and these terms over time. Material changes will be communicated by email to the account billing contact at least 30 days in advance.

14. Governing law

These terms are governed by the laws of Western Australia, Australia, and the parties submit to the exclusive jurisdiction of the courts of Western Australia.
